To be technical about it, the following comes from the
Federal Register PDF, Vol. 81 Wednesday, No. 96 May 18, 2016 AD, Part IV, Department of Health and Human Services, Office of the Secretary, 45 CFR Part 92, Nondiscrimination in Health Programs and Activities; Final Rule, RIN 0945–AA02, Nondiscrimination in Health Programs and Activities, Office for Civil Rights (OCR), Office of the Secretary, HHS, Final rule—got it?
The summary of which notes, “This final rule implements Section 1557 of the Affordable Care Act (ACA) (Section 1557). Section 1557 prohibits discrimination on the basis of race, color, national origin, sex, age, or disability in certain health programs and activities.”
The following comes from p. 31392 (or p. 18 of 99 in the PDF):
Comment: Some commenters stated that the proposed definition of sex stereotypes is unprecedented in its breadth with no legal authority to support the proposition that individuals who claim to identify with non-binary genders constitute a protected class under Title IX or any other Federal law.
Commenters suggested that it is impossible for an individual to have a non-binary gender identity.
Now, “binary genders” refers to male and female or rather male or female as in one or the other. From a Judeo-Christian perspective this gender binary was designed, was created, “male and female created he them” (Genesis 1) and any variation thereof (such as hermaphroditism) is a result of the genetic entropy which came about from the fall into sin. From an evolutionary perspective this gender binary was the result of a very long series of random chance accidents and any variation thereof is a result of the random chance genetic entropy. Thus, from this perspective the gender binary is arbitrary and, particularly with advance high tech we can take evolution into our own hands and not be forced to choose one gender or the other but neither, both or a gender the likes of which we have not as of yet imagined.

So, that was the comments and here is the reply by the Office for Civil Rights (OCR):
Response: OCR has adopted the approach taken by the Federal government and numerous courts in similar matters—that sex stereotypes encompass not only stereotypes concerning the biological differences between the sexes, but also include stereotypes concerning gender norms.1
Surely, you can discern that this is going beyond “biological differences between the sexes” and will turn to fellings. You see, for many a year LGBTQP activists sought the “gay gene” or some such concept and thought that science would deem their chosen lifestyles to be natural, normal, etc.
Well, this never happened and so the entire endeavor to have any scientific backing was tossed out in favor of the much, much easier to prove basis for dismissing the biological gender binary differences between the sexes: mere feelings.
It used to be that if it walks like a duck, quacks like a duck and looks like a duck then it is a duck. Yet, now it is that if it walks like a duck, quacks like a duck and looks like a duck then it is whatever it self-identifies as being.
This is not only a fundamental deconstruction of God’s creation and created purpose and creation of beings in His own image but a deconstruction of reality as things are not, or so we are told, that which they are but that which they merely claim to be—at any given fleeting moment, by the way.

As stated in the preamble to the proposed rule and clarified in the final rule, OCR recognizes that sex stereotypes can include the expectation that individuals consistently identify with only one of two genders (male or female), and that they act in conformity with the gender-related expressions stereotypically associated with that gender. Sex stereotypes can also include a belief that gender can only be binary and thus that individuals cannot have a gender identity other than male or female.
OCR recognizes that an individual’s gender identity involves the interrelationship between an individual’s biology, gender, internal sense of self and gender expression related to that perception; thus, the gender identity spectrum includes an array of possible gender identities beyond male and female.
Thus, we have a government mandate deconstruction of reality itself.
